A federal court will consider the issue of whether Apple’s App Store is an unfair monopoly. Seven end users have sued the company claiming just that. “Can a consumer go somewhere else to buy Angry Birds for the iPhone?” asked Alexander Schmidt, one of the plaintiffs’ attorneys. “If the answer is no, then Apple is a monopolist.”
But Apple has asked the judge to throw out the case. “There’s nothing illegal about creating a system that is closed in a sense,” Apple attorney Dan Wall argued before the court.
U.S. District Judge Yvonne Gonzalez Rogers has not said when she will rule on Apple’s motion to dismiss.
