Apple and Samsung Are Going Back to Court — Again

If you thought the Apple v. Samsung design patent lawsuit that began in 2012 ended last year when Samsung paid Apple $399 million in damages, you were mistaken.

Samsung requested a retrial in light of a new Supreme Court decision. That ruling said, in essence, that judgment awards should be based on the cost of part of the product that infringed the design patent, not on the cost of the entire product. Because the jury in this case used the cost of an entire smartphone to determine the size of the monetary award, Judge Lucy Koh has granted Samsung’s request to have the case heard again.

If Samsung’s arguments succeed in court, a new jury could order to Apple to pay back some of the money that Samsung previously paid.
